BMW of North America is facing a lawsuit filed over defective airbags installed in the automaker's X5 sport utility vehicle. The suit, which is seeking class-action status, was filed by two Florida women who allege X5 model airbags deploy without impact, potentially causing serious injury or death to a driver. One of the plaintiffs says she suffered severe chemical burns when the airbag installed in her X5 exploded while she was driving.

According to the complaint, BMW tried to cover up the problem by having the women sign a confidentiality agreement before repairs were started on their vehicles. The lawsuit says BMW dealers are instructed to have X5 owners sign agreements to keep them quiet about the faulty airbags. If successful, the lawsuit will force BMW to inspect all 2001 to 2004 X5 model airbags and prohibit further confidentiality deals.
